Is fining employees or demanding safe/register shortages be paid legal in Delaware?
Hello, I was recently employed by a franchised restaurant where the employer promised me a job title and pay I never received. While I’m sure that’s simply here say, he’s also hired an employee once fired by the corporate offices of the franchise chain, regularly keeps temperatures higher on refridgeration to keep electricity costs down and various other corner cutting. He also charges employees and managers shortages. Stating that he doesn’t demand them, but just asks and if we refuse we’re given a write up. Three of those and one is fired. I have proof of him charging myself and another manager for said shortage and another paper he signed stating that he would charge me fifty dollars every time I forgot to “tag” the back door and another fifty if caught smoking between nine and one.
Is any of this legal? If not, how much of a case do I have against him? I don’t imagine the fining of employees can be legal in many states. Any help would be greatly appreciated.
It is ILLEGAL to take a deduction from your wages and asking for a cash payment circumvents the law and is itself ILLEGAL……

Even if it was legal to have you pay this (which in many states it is) that payment or deduction can NOT take your wages for the week (of the deduction or payment) below minimum wage for the hours worked….

It is 100% LEGAL to discipline you for a shortage but the employer can NOT make you pay the money back and can NOT legally ASK you to…….
You need to contact the franchise owner or the company’s district manager and file a complaint about the cash issue and if this is not addressed report it to the state….. The state will expect you to have first contacted your employer to resolve this before they get involved……
The “fines” for policy violations are NOT legal BUT it is perfectly LEGAL to discipline you for failing to follow policies and procedures (up to termination)….
The employer does NOT even need to give you a second chance or “write you up”….
Temperatures are only an issue if cold foods are kept above 40 degrees and hot foods fall below 140 degrees….. keeping a cooler above 36 degrees does risk food expiring earlier which will increase food cost due to the waste but it is NOT illegal…… if you feel there are health violations you should contact the franchise owner or district manager and if they do NOT address the food safety issues contact the county health department and file a complaint….
