Smoking bans in restaurants?
How do you feel about them? They’re about to become a matter in my town. I for one, am completely against them. I’m not a smoker, and don’t plan to be. But isn’t it the restaurants choice? It’s their business, they’re taking the risks. I know of a county that went under the ban and the majority of the bars had to close down. I understand you not liking the smell of smoke, but you don’t have to go to the restaurant, it isn’t yours. You need to protect your rights.

Teekno: If the restaurants are doing better, that’s great. It should still be their choice. If a restaurant really thinks it will do better non smoking, they will make it non smoking.
First of all, let me say, I am a conservative and I am all for the governemnt not interfering in the rights of a private business and I am all for individuals to do whatever they choose in their private lives AS LONG as it affects only that person. If you want to smoke, you have every right to make that choice for yourself. I even have an occasional smoke myself, and I say if you want to smoke that’s your business. We all have freedom of choice and thank God for it, but our freedom of choice only extends to that which affects only ourselves. When those choices affect others around you, that’s not just about you anymore. In response to Freebie, “What if someone throws a large dinner party in their home and allows smoking how is that any different?” Easy, because it’s a PRIVATE HOME. No the government, does NOT have the right to intervene in what individuals do in their own homes because they have a right to privacy there, but that is NOT true of a public place, which is what a private business is. It might be a PRIVATE business, but it serves the PUBLIC, which does make that business answerable to certain laws and public health codes. A person does not own a business in the exact same way he/she owns a house or other kind of property, owning a business is a privilege, not a right. To keep that privilege, a business must obey laws regarding the appropriate maintenance of a business in that state. Like I said, I’m not for the government intervening in the matters of private business, but a public health interest is NOT a matter of private business. The government DOES have the responsibility to regulate safety and health concerns in a public place, and a business owner has every resonsibility under the law to insure that his/her business is a safe, healthy environment both for the customers and the employees. That’s why we have organizations like OSHA to regulate those matters. If a business had a pest infestation, is it the right of the business owner to allow it to go on, just because it’s his business? What if he thought he should be allowed to let people bring their dogs that are not service animals into his restaurant? Can he do that? No, it violates health codes. You know what? That argument works BOTH ways, if a customer or employee doesn’t like having to take their smokes outside, THEY don’t have to be there. Asker, you made the remark, ” I understand you not liking the smell of smoke, but you don’t have to go to the restaurant, it isn’t yours. You need to protect your rights.” That can just be easily said to a smoker. I understand you like to smoke, but you don’t have to go to the restaurant. IT ISN’T YOURS. Smokers DO NOT have any more OR less claim to a public place or any more or less an entitlement to be there than a non smoker, and smoking IS NOT a right, it’s a CHOICE. It’s a legal activity that people can do if they want, but it is NOT a protected right or privilege that people have. Being in a public place and expect that place to be a safe healthy environment IS a protected right citizens have. I read somewhere only about 23% of the American population smokes, so why should this be considered a smokers world and nonsmokers should just have to “deal with it” and make all the sacrifices? I hear people say, “if nonsmokers don’t like it, they can just leave,” But why? Why THEY be expected to leave? Why is it so much more reasonable fair to expect a nonsmoker to either leave or deal with inhaling second hand smoke than to expect a smoker to step outside for a minute to smoke, then come back? I’m sorry, but I just don’t understand the logic of thinking it’s selfish for nonsmokers to expect the entitlement to breathe clean air, but it’s not selfish for smokers to demand the entitlement to smoke anywhere they please, no matter what it does to anyone else. Here’s the biggest difference, smokers have the option of stepping outside for just a few minutes to smoke, nonsmokers do not have the option of flipping on a switch that let’s them breathe clean air in the midst of cigarette smoke. Smoking is completely a choice, breathing is not a choice. Honestly, who’s really being selfish and unreasonable here? Who’s really inconveniencing whom? Sorry for the wordiness, just felt the need to get that out.

However, in certain countries and in certain places rules are not followed as they are supposed to be followed. People give a damn to all the rules and do as they will. Rules and regulations are only thought to ordain the papers.

India is a country where because of its huge population and widespread corruption it sometimes becomes very difficult for the authorities to implement rules and to keep a check that they are followed properly. Public smoking ban?
My town is currently considering a public smoking ban annd it is creating a great deal of controversy. I think it would be wonderful, but many people feel that it is there right to smoke. Of course they do have a right to smoke, but what they don’t have a right to do is put another individuals health at risk in the process. Another argument I’ve heard is that non smokers can choose to go to a non smoking restaurant; no one is forcing them to eat at a smoking establishment. But why should I be inconvenienced? As far as I know there are maybe one or two restaurants in my town that are completely non smoking. When the majority of people are non smokers, that argument just doesn’t make sense. My biggest pet peeve in the entire ordeal is children. Children do not choose to go to a smoking establishment, they do not ask to have smoke blown in their face. Don’t you think that in this case, individual rights is just not a good enough reason not to allow this ban?

People have the right to as they please on their own property. In their own home, they can smoke until the cows come home. But a sex addict isn’t allowed to fornicate on a park bench because they have a craving.
I do, however, think that there are exceptions. I do not think bars should be made smoke free. They would be badly damaged in their business. And it is a child free zone, anyway. But restaurants? Absolutely. Applebees has done it and they are doing just fine.
