It’s an image issue. A majority of people in the Kellogg’s targeted demographic (families with small children) disapprove of such behavior and do not want role models who engage in those behaviors.
Look at the polls showing the response to A-Rod’s admission of using “performance enhancing” substances. Even though (at the time he used them) they were legal, a majority of baseball fans disapprove of the action.
Role models are just that, they are the examples of acceptable behavior, the standards by which others are judged, and the ideal to which we should strive. When a role model engages in generally unacceptable behavior, their value is diminished or negated.
Kellogg’s was perfectly justified in ending their contract with Phelps. I would suppose that there is probably a clause in the contract specifically prohibiting such illegal behavior. In which case, Phelps is guilty of breach of contract and got off easy if Kellogg’s only terminated the contract and did not require repayment and/or damages.
